New NPDES Permits in NC, KY, MO, AR, and VA

North Carolina

On June 1, 2023, the North Carolina Department of Environmental Quality (DEQ) released a new NPDES permit for stormwater discharges from industrial activities in the Apparel, Printing, Leather, Rubber, and Miscellaneous Manufacturing industries (NCG05000). This covers facilities with Standard Industrial Classification Codes (SIC) 23xx, 27xx, 267x, 265x, 39xx, 31xx, and 30xx. This permit has several notable revisions including the new requirement for baseline analytical monitoring and the additional requirement for a Solvent Management Plan. Beginning in 2023, baseline analytical monitoring is required quarterly at all sites for Total Suspended Solids (TSS), pH, and Chemical Oxygen Demand (COD). Feasibility studies are no longer required in the SWPPP. In addition, a Solvent Management Plan is to be added in the SWPPP if a facility uses, receives, stores, or disposes of solvents. Current permittees that did not previously have baseline analytical monitoring will start monitoring in 2024. This allows time to prepare for monitoring requirements and eDMR registration.

This covers facilities with Standard Industrial Classification Codes (SIC) 24xx with the exception of 2411, 2434, and 2491. This permit has several notable revisions including increased sampling frequency for baseline analytical monitoring and the additional requirement for a Solvent Management Plan. Beginning in 2023 baseline analytical monitoring is required quarterly versus semi-annually as required previously. Feasibility studies are no longer required in the SWPPP. In addition, a Solvent Management Plan is to be added in the SWPPP if a facility uses, receives, stores, or disposes of solvents.

Kentucky

On August 1, 2023, the Kentucky Department of Environmental Protection (DEP) is expected to release a new NPDES Permit (KYR00) for stormwater discharges from industrial activities. Changes compared to the existing permit have not been issued at this time.

Missouri

On September 7, 2023, the Missouri Department of Natural Resources (DNR) is expected to release a new NPDES Permit for stormwater discharges for industrial activities from production of paper and allied products, textiles and apparel products, printing and publishing operations and paper-only recycling, and food and kindred products manufacturing operations (MO-R130000). This covers facilities with Standard Industrial Classification Codes (SIC) 20xx, 22xx, 23xx, 26xx, 27xx, and 5093. This permit has a couple of proposed revisions including updates to the SWPPP and a requirement that the facility map is to be maintained with the SWPPP. A proposed change will increase the SWPPP update frequency to being reviewed annually and updated as necessary or as site conditions change along with the SWPPP implementation due dates being updated.

Arkansas

On July 1, 2024, the Arkansas Department of Environmental Quality (DEQ) is expected to release a new NPDES Permit (ARR000000) for stormwater discharges from industrial activities. Changes compared to the existing permit have not been issued at this time.

Virginia

On July 1, 2024, the Virginia Department of Environmental Quality (DEQ) is expected to release a new NPDES Permit (VAR05) for stormwater discharges from industrial activities. Changes compared to the existing permit have not been issued at this time.
